नई दिल्ली,6नवंबर। दिल्ली के मुख्यमंत्री अरविंद केजरीवाल की पत्नी सुनीता केजरीवाल को बड़ी राहत मिली. उन पर दो वोटर आईडी कार्ड रखने का आरोप है. इसी मामले में ट्रायल कोर्ट ने सुनीता को समन जारी किया था. जिस पर दिल्ली हाईकोर्ट ने रोक लगा दी है. ये मामला भाजपा नेता हरीश खुराना की शिकायत पर दर्ज किया गया था. 28 अगस्त 2023 को समन जारी किया गया था.
जस्टिस अमित बंसल ने आदेश पारित किया और कहा कि ट्रायल कोर्ट के आदेश पर रोक 1 फरवरी, 2024 तक लागू रहेगी जब मामले की अगली सुनवाई होगी.
तीस हजारी कोर्ट की मेट्रोपॉलिटन मजिस्ट्रेट अरजिंदर कौर ने 29 अगस्त, 2023 को सुनीता केजरीवाल को समन जारी किया था.
क्या है पूरा मामला?
खुराना ने 2019 में सुनीता केजरीवाल के खिलाफ शिकायत दर्ज कराई थी कि वो दिल्ली के साहिबाबाद (गाजियाबाद निर्वाचन क्षेत्र) और चांदनी चौक की मतदाता सूची में मतदाता के रूप में पंजीकृत हैं, जो जन प्रतिनिधित्व अधिनियम की धारा 17 का उल्लंघन है. ट्रायल कोर्ट ने मामले को सुनने के बाद समन जारी किया था.
सीनियर एडवोकेट रेबेका जॉन केजरीवाल की ओर से पेश हुईं और हाईकोर्ट को बताया कि जन प्रतिनिधित्व अधिनियम के अनुसार, अपराध तभी बनता है जब कोई व्यक्ति गलत घोषणा प्रस्तुत करता है और इस मामले में, खुराना ने रिकॉर्ड पर ऐसा कुछ भी नहीं रखा है जिससे की गई घोषणा झूठी साबित हो.
बेंच ने मामले पर विचार किया और ट्रायल कोर्ट के आदेश पर रोक लगा दी.अब इस मामले की सुनवाई 1 फरवरी 2024 को होगी.
